State Commission Rules on NISP 401 Water Quality Certification Appeal

The Colorado Water Quality Control Commission has ruled to uphold the 401 water quality certification for the Northern Integrated Supply Project, rejecting appeals.  

Earlier this year, the Colorado Department of Public Health and Environment had issued a water quality certification for the project under Section 401 of the Clean Water Act. However, an environmental group challenged the permit, triggering the commission’s reexamination of the certification. 

With the ruling, NISP has completed the administrative process surrounding the water quality certification. It joins the issuance of the Larimer County 1041 permit as a major milestone for 2020. A federal Record of Decision on the Clean Water Act permit is expected in early 2021.
